Forschungsgegestand: „Translating Guilt: Applying the language of functional perpetration to international criminal law“

A PhD thesis comparing modes of responsibility in common law and civil law countries for collective crimes, in order to see if the notion of functional perpetration can be applied for International crimes. This is a mode of responsibility which holds the leader of an organisation culpable for the collective crimes committed by his or her subordinates, due to the function of the leader and their failure to fulfil this function by preventing the crime, or by facilitating the crime. The Dutch notion of functional perpetration is the starting point, I wish to compare this with the German notion of Organisationsherrschaft, and later with Latin American use of this notion and with common law modes which may be similar.
