Breve descripción: La observancia de las garantías procesales no tiene siempre contenido epistémico, al contrario en más de una ocasión, las cortes se enfrentan con situaciones en las que debe optarse por una decisión que favorezca la verdad o los derechos del acusado en el proceso. El tema se vuelve aún más delicado cuando entran en juego razones de interés público. De ahí la necesidad de que hayan criterios claros respecto de cómo ponderar la verdad y los derechos humanos.

A PhD thesis comparing modes of responsibility in common law and civil law countries for collective crimes, in order to see if the notion of functional perpetration can be applied for International crimes. This is a mode of responsibility which holds the leader of an organisation culpable for the collective crimes committed by his or her subordinates, due to the function of the leader and their failure to fulfil this function by preventing the crime, or by facilitating the crime. The Dutch notion of functional perpetration is the starting point, I wish to compare this with the German notion of Organisationsherrschaft, and later with Latin American use of this notion and with common law modes which may be similar.
